The Jay County Prosecutor's Office has an Infraction Deferral Program that may be available for individuals charged with traffic infractions (i.e. speeding tickets or traffic tickets). If an offender is eligible, the offender must enter into an agreement with the Jay County Prosecuting Attorney that he/she will not commit another moving traffic offense for the length of the deferral period. Deferral periods are for either 6 months or 12 months, depending on the offense. The Prosecuting Attorney will determine the length of the deferral period. The offender must pay the fees associated with administering the deferral program. The 6 month deferral fee is $195.50. The 12 month deferral fee is $255.50. Full Payment must be made by cash or money order to the clerk of the court. If the offender successfully completes the terms of the deferral agreement, the ticket will be dismissed and the offense will not be reported to the BMV. There are strict eligibility requirements for offenders seeking to have their tickets deferred. Out of State Drivers are required to provide to the office of the Prosecuting Attorney a copy of their driving record. Offenders holding a Commercial Driver's License (CDL) are NOT eligible for an Infraction Deferral.
Misdemeanor Diversion Program
The Jay County Prosecutor's Office has available a Misdemeanor Diversion Program for persons charged with certain misdemeanor offenses. The Misdemeanor Diversion Program consists of a written agreement between the defendant and the Prosecuting Attorney that contains certain terms of which the defendant must comply. If eligible, the defendant must pay the Diversion Program fees, agree to refrain from engaging in criminal conduct for the period of the diversion period, agree to complete a term of community service and may also be required to attend appropriate counseling sessions. Other terms may be added at the Prosecuting Attorney's discretion. Diversion periods are for 6 months or 12 months. The fee for a 6 month diversion is $334.00 (plus community service fees and counseling fees, if any). The 12 month diversion fee is $454.00 (plus community service fees and counseling fees, if any). If the defendant successfully completes the terms of the diversion agreement, the charges against the defendant will be dismissed.
Diversion agreements are offered at the sole discretion of the Prosecuting Attorney. Certain offenses are not eligible for diversion. See I.C. 33-39-1-8 for a complete list of crimes that are not eligible for the Diversion Program. Defendants must meet strict eligibility requirements to participate in the Diversion Program.
